Where to File in California
MDL 3014 — All California CPAP/BiPAP cancer claims are consolidated in the Western District of Pennsylvania before Chief Judge Joy Flowers Conti in Pittsburgh. California plaintiffs file locally then transfer automatically via the JPML transfer order; no separate motion is required once the case is docketed in any federal district.
California Statute of Limitations — California Code of Civil Procedure § 335.1 provides a two-year window for personal injury and products liability claims. The discovery rule tolls the period from the date a plaintiff knew or reasonably should have known of the injury and its connection to the Philips Respironics recall, which FDA announced as a Class I recall in June 2021.
Transfer to MDL 3014 — After filing in any California federal district (N.D. Cal., C.D. Cal., E.D. Cal., or S.D. Cal.), the Judicial Panel on Multidistrict Litigation transfers the case to W.D. Pa. under 28 U.S.C. § 1407. California cases join over 100,000 claims alleging that PE-PUR foam degradation released TDI and DMFA carcinogens during device use.
California Recall Registration — California had among the highest concentrations of recalled Philips DreamStation, System One, and CPAP Pro devices. Affected California users should register through the Philips recall portal and retain CPAP compliance data downloads from their device app as evidence of use duration.
