Statute of Limitations
Florida Statute § 95.11(3)(e) imposes a 2-year limitations period for products liability claims. The discovery rule applies — the period runs from when the plaintiff discovered or through the exercise of due diligence should have discovered the injury. Florida's 12-year statute of repose (Fla. Stat. § 95.031(2)(b)) is a hard cutoff measured from product delivery. Patients implanted before 2014 should consult an attorney immediately to evaluate repose exposure under Florida law.

Where to File in Florida
Florida hernia mesh claimants are routed to federal MDLs based on the implanted device: Davol/CR Bard products to MDL 2846 (S.D. Ohio, Judge Sargus); Covidien Parietex to MDL 2511 (S.D. Ohio, Judge Sargus); Atrium C-QUR to MDL 2753 (D.N.H.); and Johnson & Johnson/Ethicon Physiomesh or Prolene Hernia System cases to the Atlantic County NJ Superior Court mass tort before Judge John Porto.
Florida's statute of limitations for products liability is four years from the date of injury or discovery under Florida Statute § 95.11(3)(e). The discovery rule tolls the period when the plaintiff could not reasonably have known the mesh caused the injury. Florida courts have recognized that mesh complications — including erosion through bowel or abdominal wall, chronic seroma, and fistula — commonly manifest years post-operatively, supporting delayed accrual arguments.
Florida's large retiree population and high rate of elective surgical procedures make it one of the top three states nationally for hernia mesh implant volume. Miami, Tampa, Orlando, and Jacksonville hospital systems report substantial Bard Davol and Covidien Parietex device usage. Florida plaintiffs with Atrium C-QUR cases benefit from an active litigation track in MDL 2753, where bellwether trials have proceeded.
Ethicon/J&J Florida plaintiffs should file directly in Atlantic County, NJ Superior Court under New Jersey's mass tort designation rather than pursuing a federal MDL transfer. Judge Porto manages the Ethicon docket separately, and Florida-based injuries are fully cognizable in that forum with appropriate venue transfer coordination.
