Where to File in Illinois
Exactech knee, hip, and ankle implant cases are consolidated in MDL 3062 — In re: Exactech Polyethylene Orthopedic Products Liability Litigation — in the Middle District of Florida before the Honorable Marcia G. Cooke (Miami Division). MDL 3062 was established in 2022 following Exactech's global recall of approximately 147,000 defective implants. The recall was triggered by a vacuum packaging breach affecting UHMWPE (ultra-high-molecular-weight polyethylene) bearing inserts in the Optetrak Logic, GPS Knee, and Novation Hip systems; improperly packaged inserts were exposed to oxygen during the manufacturing or storage process, causing oxidative degradation that substantially accelerates wear and increases the risk of catastrophic implant failure requiring revision surgery years ahead of the expected device lifespan. Exactech Inc. has been a subsidiary of private equity firm TPG Capital since 2018.
Illinois sets a two-year statute of limitations for product-liability personal injury claims under 735 ILCS 5/13-202. Illinois also recognizes the discovery rule: the limitations period begins when the plaintiff knew or should have known of the injury and its causal relationship to the Exactech device defect.
Illinois is a top-ten state for orthopedic procedure volume, led by Northwestern Memorial Hospital (Chicago), Rush University Medical Center, and Loyola University Medical Center. The Chicago metro area saw high Exactech Optetrak and GPS Knee implant utilization through its major orthopedic programs. Post-recall revision consult volumes at these systems have been elevated since late 2022.
Illinois plaintiffs file in the N.D. Ill. (Chicago) or C.D. Ill./S.D. Ill. The JPML issues a conditional transfer order routing the case south to MDL 3062 in M.D. Florida. Illinois counsel routinely participate in MDL pretrial proceedings via remote appearances, with in-person appearances required for key hearings before Judge Cooke.
