Where to File in New York
Venue & MDL Status: New York plaintiffs may file in the Eastern District of New York (Brooklyn), the Southern District of New York (Manhattan), or the Northern District. The E.D.N.Y. and S.D.N.Y. are high-volume federal courts with established protocols for complex consumer class actions. Beech-Nut Nutrition Corporation is incorporated in New York, making it subject to general personal jurisdiction statewide and establishing New York as a critical venue regardless of where a plaintiff resides. No centralized MDL exists as of early 2025.
Statute of Limitations: New York imposes a three-year statute of limitations for products-liability and personal-injury claims under CPLR § 214(5). For minors, CPLR § 208 tolls the limitations period until the child reaches age 18 (subject to a maximum of ten years from accrual), providing meaningful protection for infant plaintiffs. New York courts apply the discovery rule where injuries are inherently unknowable.
Consumer Protection: New York General Business Law § 349 prohibits deceptive acts and practices in consumer transactions. Plaintiffs need only show that the challenged conduct was consumer-oriented, misleading to a reasonable consumer, and resulted in actual injury. Section 349 claims may be brought individually without class certification, and successful plaintiffs recover actual damages or $50 per violation (whichever is greater), trebled for willful violations, plus attorney's fees.
Defendant Distribution: Beech-Nut Nutrition Corporation — one of the primary defendants named in the 2021 Congressional report — has its principal manufacturing operations in New York (Canajoharie plant). Gerber products are extensively distributed through New York grocery chains. Hain Celestial (Earth's Best) was founded in New York and maintains headquarters in Lake Success, NY, making New York a natural venue for Hain claims. Sprouts brand baby foods were sold through Sprouts stores absent in New York but through national retailers present statewide.
