Where to File in Ohio
Ohio TRT cases filed in federal court — including the N.D. Ohio, S.D. Ohio, or other districts — are transferred to MDL 2545 in the Northern District of Illinois before Judge Matthew Kennelly in Chicago. Ohio has contributed significant plaintiff numbers to MDL 2545. The MDL has been largely resolved through global settlements with AbbVie, Endo, and Auxilium, but new Ohio cases alleging cardiovascular injuries from TRT products including AndroGel, Axiron, Androderm, and Testim continue to be accepted for review and filing.
Ohio's statute of limitations for personal injury and products liability is two years under Ohio Rev. Code § 2305.10. Ohio applies the discovery rule, tolling the limitations period until the plaintiff discovered or should have discovered that the injury was caused by a TRT product. Ohio courts have applied this rule in pharmaceutical mass tort cases, generally finding that limitations begins when a reasonable person would have linked the injury to the product — typically upon physician notification or media coverage of the MDL. Prompt consultation with counsel is essential to preserve Ohio claims.
Ohio has significantly elevated rates of cardiovascular disease and TRT prescribing, particularly in Cleveland, Columbus, Cincinnati, and Akron. The state's male population aged 45–65 in post-industrial communities has high rates of hypertension, obesity, and coronary artery disease — conditions that increase vulnerability to TRT-related cardiovascular events. Ohio's major health systems, including Cleveland Clinic, OhioHealth, and UC Health, treated many men who suffered heart attacks or strokes while on TRT.
Ohio plaintiffs may file in Ohio state courts or in federal courts within Ohio, with N.D. Ohio (Cleveland) and S.D. Ohio (Columbus) being the primary federal venues. Ohio applies strict products liability for design defect and failure-to-warn claims and recognizes punitive damages for conduct showing malice or aggravated or egregious fraud. Ohio Rev. Code § 2307.71 et seq. governs Ohio products liability actions and allows recovery for compensatory and punitive damages subject to caps applicable only to punitive awards.
